Governor Tarc\u00edsio de Freitas sanctioned this Monday (2), at an event at Pal\u00e1cio dos Bandeirantes, Bill No. 1,246\/2023, approved by the Legislative Assembly (Alesp) last week. Known as Resolve J\u00e1, the measure encourages self-regularization, allowing companies with debts from ICMS infraction notices to pay them off with more time, greater discounts and new payment possibilities.<\/p>\n
\u201cWe are modernizing our relationship with taxpayers, making it simpler\u201d, highlighted Governor Tarc\u00edsio \u201cSefaz-SP understands the challenge we have and is offering us bold solutions, innovative solutions, which will allow S\u00e3o Paulo to grow, generating jobs and income\u201d, he continued.<\/p>\n
The measure prepared by the Secretariat of Finance and Planning (Sefaz-SP) expands payment possibilities with better conditions for the taxpayer, covering all infraction notices up to registration in Active Debt, allowing the inclusion of AIIMs contested through administrative means and reducing the litigation. A major innovation of Resolve J\u00e1 is that it allows payments to be made using accumulated ICMS credits and amounts resulting from tax replacement reimbursement \u2013 which was previously not possible.<\/p>\n
\u201cThis construction, in line with our principles and well coordinated, was managed by our technical team in a competent manner\u201d, emphasized Samuel Kinoshita, secretary of Sefaz-SP.<\/p>\n
Resolve J\u00e1 predicts that the discounts will be greater the sooner the infraction notice is paid \u2013 reaching up to 70% if paid in cash, within 30 days. With discounts and installments, effective fines reach very reasonable and attractive levels for companies.<\/p>\n
A fine originally of R$ 35 thousand, for example, after the discount for withdrawing from administrative litigation and with payment in cash, can fall to around R$ 4 thousand. This reduction allows companies to settle debts and work with more financial strength.<\/p>\n
\u201cThe Legislative Assembly worked a lot on this project, which was already ready. The Sefaz-SP team was at the House the entire time at the disposal of the deputies\u201d, stated deputy Andr\u00e9 do Prado, president of Alesp. \u201cIn 20 years of Alesp I have not seen a project as bold as this. It is a project that breaks paradigms, allowing economic development to prosper\u201d, said deputy Vin\u00edcius Camarinha, rapporteur of the proposal in the S\u00e3o Paulo Assembly.<\/p>\n
\u200bWith Resolve J\u00e1, the State Government and the Treasury Department hope to reduce the backlog of processes being discussed administratively, encouraging ICMS collection and compliance, reducing administrative litigation. This will allow S\u00e3o Paulo to grow, create jobs and build the best business environment in Brazil, by far.<\/p>\n
